Divorcing between Maltese Citizen & Non - Eu

Hello

I am married with a Maltese Citizen since 3 years but we are planning to go to seperation. I told her that we can start the process, because it already takes 4 years, but she said if we start I can lose my residence permit and she also suggested to wait another 2 years for getting Maltese citizenship. We have a son and she does not want me to stay away from him.

So I am asking. If we apply to court for seperation, thus they will remove my residence permit? What is your suggestion about this circumtance. Because I do not want to stay away from my son.

Thanks in advance.

With something as sensitive as the custody of your child, I would recommend going to a lawyer seeking advice, rather than relying on an expat forum.

As I understood the post, he was not asking about custody advice, but rather his residence status if he proceeds with separation/divorce.  I'm sure there's expats here that can offer advice or insight about that question.

Right but in most instances, if a member shares incorrect information based on their experience/knowledge which OP relies in, the consequences aren't quite as severe as not being able to be with your child.

Find an immigration lawyer to guide you through your immigration and visa procedures in Malta.

Of course I will be contacted with a lawyer but before I wanted to hear somethings from people who has experience.
